These Terms of Service govern access to and use of HiveMoments, including the public website, user accounts, event galleries, guest upload tools, paid features, and related services.

HiveMoments is committed to protecting your privacy and maintaining a safe, trusted platform for event hosts and guests.

In simple terms: HiveMoments helps you collect and share event memories privately, and we only use your information to make that experience work safely and reliably.

1. Acceptance of Terms

By accessing or using HiveMoments, you agree to these Terms of Service. If you do not agree, do not use HiveMoments.

If you use HiveMoments on behalf of an organization, client, school, team, or other group, you represent that you have authority to act for that party and to bind that party to these Terms.

2. Description of Service

HiveMoments is a private event photo and media sharing service. It helps hosts and organizers collect guest uploads, manage event galleries, review or approve submissions, and share or download event memories through product features made available by HiveMoments.

Features may change over time and may differ based on account type, event configuration, plan level, geography, product maturity, or operational requirements.

3. Eligibility and Account Responsibility

You are responsible for your account, your event configuration choices, and the activity that occurs through your credentials or event links. You must provide accurate information when creating an account or making a purchase where that information is required.

You may use HiveMoments only if you are legally able to do so under applicable law and, where relevant, able to enter into a binding agreement yourself or on behalf of the organization or event you represent.

• Keep your credentials, access links, and private gallery links secure.
• Promptly update inaccurate account or billing information.
• Use reasonable care when inviting guests, sharing access, or configuring event visibility and moderation settings.

4. User Content

Users may upload photos, videos, captions, comments, and other content (“User Content”) to HiveMoments.

You retain ownership of your User Content. By uploading content, you grant HiveMoments a limited, non-exclusive, worldwide license to host, store, process, display, and distribute that content solely for the purpose of operating, improving, and providing the service.

You are responsible for ensuring that you have all necessary rights, permissions, and consents to upload and share User Content, including consent from individuals appearing in the content where required.

HiveMoments does not claim ownership of User Content and does not use it for purposes unrelated to providing the service.

HiveMoments may remove or restrict access to User Content that violates these Terms, applicable laws, or platform policies.

You grant HiveMoments a limited, non-exclusive license to store, process, and display content solely for the purpose of providing the service. Use of the service is also subject to HiveMoments’ Fair Usage Policy.

5. User Conduct and Related Policies

You agree to use HiveMoments only for lawful, authorized, and appropriate event-related purposes.

You may not:

• Upload or share content that is unlawful, harmful, abusive, defamatory, or violates the rights of others
• Attempt to access accounts, systems, or data without authorization
• Interfere with the operation, security, or performance of the service
• Use the service for spam, fraud, scraping, or automated abuse

Your use of HiveMoments is also subject to our Acceptable Use Policy and Content Policy, which are incorporated into these Terms.

HiveMoments may suspend or terminate access where violations occur.

6. Event and Sharing Controls

HiveMoments provides tools that allow hosts to manage event galleries, guest access, uploads, moderation, and sharing.

Hosts are responsible for configuring event settings, including access permissions, approval workflows, and sharing controls.

Guests may be granted access through links, QR codes, or other invitation methods. Anyone with access to an event link may be able to view or contribute content depending on the event configuration.

HiveMoments is not responsible for how event links are shared or used by hosts or guests.

7. Subscription and Paid Features

Certain HiveMoments features may require payment, including event upgrades or subscription plans.

Payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe’s terms and privacy policy.

Pricing, billing terms, and included features are presented at the time of purchase.

For subscription-based plans:

• Subscriptions may renew automatically at the end of each billing period unless canceled
• You may cancel your subscription at any time before the next billing cycle
• Cancellation prevents future billing but does not retroactively refund prior charges

For one-time purchases (such as event upgrades):

• Charges are applied at the time of purchase
• Access to paid features is granted based on the selected plan

HiveMoments reserves the right to change pricing, features, or billing structures with reasonable notice.

Refunds, if applicable, are handled in accordance with the HiveMoments Refund Policy.

8. Changes to Service and Availability

HiveMoments may update, modify, or discontinue features at any time to improve the service.

We aim to provide reliable access but do not guarantee uninterrupted or error-free operation.

Service availability may be affected by maintenance, infrastructure providers, or external factors beyond our control.

9. Suspension and Termination

HiveMoments may suspend or terminate access to the service where necessary to:

• Enforce these Terms or related policies
• Prevent fraud, abuse, or security risks
• Comply with legal obligations

You may stop using the service at any time.

Termination may result in loss of access to content or features, subject to applicable policies and retention practices.

10. Intellectual Property

Except for user content, HiveMoments and its licensors own the service, software, interface, branding, design, text, graphics, workflows, and related site content. Those materials are protected by intellectual property laws and may not be copied, modified, distributed, scraped, reverse engineered, or reused except as permitted by law or by explicit written permission.

• These Terms do not give you ownership of HiveMoments software, branding, or site materials.

11. Third-Party Services

HiveMoments relies on third-party services including cloud storage providers, video processing services, and payment processors (such as Stripe). HiveMoments is not responsible for outages, data loss, or performance issues caused by third-party providers.

12. Content Storage & Availability

HiveMoments does not guarantee permanent storage of any content. Users are responsible for maintaining their own backups of important media.

13. Copyright & DMCA

HiveMoments respects intellectual property rights. If you believe content infringes your copyright, you may submit a takedown request to legal@buildwithtfs.com including:

• Identification of the copyrighted work
• URL of infringing content
• Contact information
• Statement of good faith belief

Repeat violations may result in account termination.

11. Disclaimers

To the extent permitted by applicable law, HiveMoments is provided on an “as available” and “as is” basis. HiveMoments does not guarantee uninterrupted availability, permanent storage, perfect accuracy, or that every feature will always perform exactly as expected in every environment.

HiveMoments also does not control all user-generated content and is not responsible for the conduct of every user, guest, or third party. Nothing in this section excludes any rights or protections that cannot be excluded under applicable law.

12. Limitation of Liability

To the maximum extent permitted by law, HiveMoments shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, content, revenue, or profits.

HiveMoments provides the service “as is” and “as available” without warranties of any kind.

In no event shall HiveMoments’ total liability exceed the amount paid by you (if any) for the service in the preceding 12 months.

13. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold HiveMoments, its operators, and their respective personnel harmless from third-party claims, losses, liabilities, and reasonable costs arising out of or related to your content, your misuse of the service, your violation of these Terms or related policies, or your violation of another person’s rights, to the extent caused by you or those using the service through your account or event access under your control.

14. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Wyoming, without regard to conflict of law principles.

Any disputes arising from these Terms or use of the service shall be resolved in the appropriate courts located in Wyoming, unless otherwise required by applicable law.

15. Changes to Terms

HiveMoments may update these Terms from time to time to reflect service changes, product development, legal developments, billing changes, or operational needs. When HiveMoments updates these Terms, the revised version will replace the prior version as of the effective date shown on the page unless a different date is stated.

Your continued use of HiveMoments after updated Terms take effect means the revised Terms will apply going forward, subject to applicable law.
